These Terms of Service ("Terms") govern your use of the creative services and website operated by Viral Thumbs, a trading name of Carson Alworth located in Crosbyton, TX 79322. By accessing our site, subscribing, or submitting a project brief, you agree to these Terms.
Services
We provide thumbnail ideation, design, and related consulting. Services begin once payment is confirmed, required assets are received, and the creative queue has availability. Delivery timelines are estimates and depend on the complexity of each request.
Payments and Renewals
- All plans renew automatically each billing cycle through Stripe unless you cancel before the next charge.
- Fees are listed in U.S. dollars and exclude any applicable taxes.
- We offer a 14-day money-back guarantee on new subscriptions; refunds after that window are evaluated case-by-case.
Client Responsibilities
- Provide accurate briefing details, usage rights to any reference assets, and timely feedback.
- Use deliverables in accordance with relevant platform policies and applicable laws.
- Maintain the confidentiality of any shared logins or private project links.
Intellectual Property
Upon full payment, you receive a perpetual, royalty-free license to use the final thumbnails and design files for your channels. We reserve the right to showcase anonymized work samples unless you request otherwise in writing.
Prohibited Uses
You may not resell our creative system, misrepresent affiliation, or request materials that promote hate speech, illegal activity, or misinformation. We may terminate access if a request violates these standards.
Limitation of Liability
To the fullest extent permitted by law, Viral Thumbs and Carson Alworth are not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid in the preceding 30 days.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes will be handled in state or federal courts located nearest to Lubbock County, Texas.
Updates
We may revise these Terms from time to time. Updates take effect when posted, and continued use of the site or services signifies acceptance of the revised Terms.
